By accessing or using Chartivo (“Service”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree, please do not use our Service.

Description of Service

Chartivo provides a platform for creating live, interactive charts from data sources (such as Stripe, AWS CloudWatch) and embedding them in various tools (Notion, Jira, Google Docs, etc.).

User Accounts

Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 18 years old to use the Service
• One person or entity may not maintain more than one free account

Account Responsibilities

• You are responsible for all activity that occurs under your account
• Notify us immediately of any unauthorized use of your account
• We reserve the right to suspend or terminate accounts that violate these Terms

Acceptable Use

You agree not to:

• Use the Service for any illegal or unauthorized purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service or servers
• Use automated means to access the Service without permission
• Reverse engineer or attempt to extract source code
• Violate any applicable laws or regulations
• Share account credentials with unauthorized parties

Data and Privacy

Your Data

• You retain all rights to your data
• You grant us permission to access your data sources (read-only) to provide the Service
• We only access and process data necessary to create your charts

Data Security

• We implement industry-standard security measures
• We are not liable for data breaches resulting from your own security failures
• You are responsible for maintaining secure access to your data sources

Intellectual Property

Your Content

• You retain ownership of your chart configurations and content
• You grant us a license to display and distribute your charts as per your embedding settings

Our Content

• The Service, including software, design, and branding, is owned by Chartivo
• You may not copy, modify, or distribute any part of the Service without permission
• Chartivo’s name, logo, and trademarks may not be used without authorization

Payment Terms

Subscription Plans

• Subscription fees are charged in advance on a monthly or annual basis
• All fees are in USD and non-refundable except as required by law
• We reserve the right to change pricing with 30 days notice

Free Trial

• New accounts receive a 30-day free trial
• No credit card required for the trial period
• After trial expiration, paid features require a subscription

Billing

• You authorize us to charge your payment method for applicable fees
• Failed payments may result in service interruption or account suspension
• You are responsible for all taxes associated with your purchase

Service Modifications and Interruptions

• We may modify, suspend, or discontinue the Service at any time
• We will provide reasonable notice for significant changes
• We are not liable for any service interruptions or modifications
• Scheduled maintenance may temporarily affect service availability

Termination

By You

• You may cancel your account at any time through account settings
• Cancellation takes effect at the end of your current billing period
• No refunds for partial subscription periods

By Us

• We may suspend or terminate your account for violation of these Terms
• We may terminate accounts that remain inactive for extended periods
• We will provide notice when reasonably possible

Disclaimers and Limitations of Liability

Service “As Is”

• The Service is provided “as is” without warranties of any kind
• We do not guarantee uninterrupted, error-free, or secure service
• We do not warrant that charts will be accurate or reliable

Limitation of Liability

• To the maximum extent permitted by law, Chartivo shall not be liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
• Some jurisdictions do not allow liability limitations, so these may not apply to you

Indemnification

You agree to indemnify and hold harmless Chartivo from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights

Third-Party Services

• The Service integrates with third-party platforms (Stripe, AWS, Notion, etc.)
• Your use of third-party services is subject to their terms and policies
• We are not responsible for third-party service availability or changes

Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of competent jurisdiction.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the revised Terms.
